Acceptable Use Policy
Operated by Oneloop Inc. (a Delaware corporation), doing business as Careship
Effective Date: May 31, 2026
This Acceptable Use Policy (“AUP”) governs your use of the Careship Platform operated by Oneloop Inc., doing business as Careship (“Oneloop,” “Careship,” “we,” or “us”). It is incorporated into and forms part of our Terms and Conditions and End User License Agreement. Capitalized terms have the meanings given in those documents.
This AUP exists to keep the Platform safe, lawful, and reliable for every Customer and every Member. Violation of this AUP is a material breach and may result in immediate suspension or termination, with no refund.
1. Protected Health Information
The Platform is built for non-clinical, front-desk, growth, and communication workflows. It is not a system of record for clinical data. You agree that you will not:
- Input, upload, paste, or store structured Protected Health Information, electronic medical records, lab results, diagnoses, or clinical documentation in Platform fields, knowledge bases, forms, or configurations.
- Use the Platform as a substitute for an electronic health record or clinical system.
- Process PHI through the Platform without first executing a Business Associate Agreement with Oneloop.
You are responsible for training your personnel to avoid entering PHI and for governing any health information a Member may voluntarily disclose during a conversation.
2. Consent and Communications
The Platform places calls, sends messages, and records conversations. You are solely responsible for legal compliance for every communication. You agree that you will:
- Obtain all consents required to call, text, and email Members, including under the Telephone Consumer Protection Act.
- Obtain all consents required to record calls, including all-party consent in states that require it.
- Honor opt-out and do-not-contact requests promptly.
- Not use the Platform to send spam, unsolicited bulk messages, or deceptive communications.
You will not use the Platform to contact any person from whom the required consent has not been obtained.
3. Artificial Intelligence Conduct
Because Ela interacts with the public on your behalf, you agree that you will:
- Permit Ela to identify itself as an artificial intelligence agent and not configure it to impersonate a human.
- Not use Ela to provide medical advice, diagnosis, or treatment recommendations to Members.
- Not configure Ela to deceive, manipulate, or mislead Members, or to make false or unsubstantiated claims about your practice or services.
- Not use the Platform to generate unlawful, discriminatory, harassing, or harmful content.
4. Prohibited Activities
You will not, and will not allow anyone using your account to:
- Use the Platform for any unlawful, fraudulent, or deceptive purpose.
- Violate the rights of others, including privacy, publicity, and intellectual property rights.
- Upload or transmit malware, viruses, or harmful code.
- Probe, scan, or test the vulnerability of the Platform or breach its security or authentication.
- Gain or attempt to gain unauthorized access to the Platform, accounts, or systems.
- Interfere with or disrupt the integrity or performance of the Platform, including through excessive automated requests.
- Reverse engineer, copy, resell, sublicense, or create derivative works of the Platform.
- Use the Platform to build, train, or benchmark a competing product or service.
- Misrepresent your identity or affiliation, or impersonate any person or entity.
- Circumvent usage limits, rate limits, or access controls.
- Use the Platform to collect or harvest information about others without authorization.
5. Data and Account Responsibility
You are responsible for all activity under your account, the accuracy of your configurations, and the lawfulness of the content you provide. You must keep your credentials secure and notify us immediately of any suspected unauthorized access or security incident.
6. Enforcement
We may investigate suspected violations of this AUP. We may, at our discretion and without prior notice where appropriate:
- Issue a warning or require corrective action.
- Suspend or throttle access to the Platform or specific features.
- Remove or disable offending content or configurations.
- Terminate your account and license.
- Report activity to law enforcement or regulatory authorities where required.
Suspension or termination for a violation does not entitle you to any refund and does not limit our other rights and remedies, including indemnification under the Terms and Conditions.
7. Reporting
To report a suspected violation of this AUP or any security concern, contact us at hello@careshiphealth.com. We appreciate good-faith reports and will respond as appropriate.
8. Changes
We may update this AUP from time to time. Material changes will be posted with an updated effective date. Your continued use of the Platform after changes take effect constitutes acceptance.
